5. Tkscontracting.com is an official TKS private system, which may be used only for authorized purposes. The TKS and its agents may monitor and audit the usage of this system, and all persons are hereby notified that use of this system constitutes consent to such monitoring and auditing.

11. This Agreement shall be governed by, construed and enforced in accordance with the laws of the State of West Virginia as applied to agreements made and to be performed entirely therein. Any action brought to enforce the Agreement or in connection with the Tkscontracting.com Website shall be brought in either the state or federal courts in Upshur County, West Virginia.
PRIVACY POLICY
Introduction
The TKS is committed to maintaining your online privacy. The TKS’s online Privacy Policy applies to data collected from TKS’s website. The Privacy Policy also applies to information collected from users of our official Facebook page TKS Contracting, Inc. (https://www.facebook.com/TKSContractingInc) and official LinkedIn page TKS Contracting, Inc. (https://www.linkedin.com/company/tks-contracting-inc).
In order to improve the content and usability of this website, the TKS automatically collects several categories of information from users. This information includes the following:
1. The apparent Internet Protocol (“IP”) address of your Internet Service Provider (“ISP”) and/or your computer, if your computer has an IP address assigned directly to it.
2. The apparent Fully Qualified Domain Name (“Domain Name”) of your Internet Service Provider (“ISP”) and/or your computer, if your computer has a domain name assigned directly to it.
3. The type of browser (such as, for example Internet Explorer, Opera, Firefox, Chrome, etc.) used and the operating system resident on a user’s computer.
4. The date and time a user visited the site.
5. The web pages accessed at the site, as well as any applications used and forms data.
6. The Uniform Resource Locator (“URL”) of the site which a user visited prior to Tkscontracting.com (if detectable), if such user did not connect directly to Tkscontracting.com, or use it as a homepage or “Portal”.
TKS uses this information to identify site performance needs; to ensure compatibility with the technology used by Tkscontracting.com visitors, and to generally add and improve services offered on Tkscontracting.com. In order to accomplish those goals, from time to time, TKS may conduct statistical analysis of the data it collects.

Information Submitted to TKS

Using TKS services
If you send TKS an email, or provide your email to TKS thorugh other online Services, to request information or data, submit questions or comments about our programs or services, or to access or obtain such programs or services, we do collect your email address and any other information that you optionally provide [such as address and phone number]. If you visit Tkscontracting.com to read or download information, such as events schedules or building permits, we only capture and store the domain name of your computer (for example, gmail.com) and other related information to speed up the performance of web page delivery. We collect no other personal information. We do this to improve our online services, and occasionally, to customize its content for the individual user. You may choose to login to the relevant website or mobile app and add or update this information at any time.
If you opt to provide your email or phone number to TKS, we also do so to maintain the information for service responsiveness and records purposes. If provided, we may contact you about that request to obtain additional information if necessary.

Data Sharing
TKS understands the value of personal information and works to protect the personal information we collect from the public. We do not collect personal information without your permission. Any information that you volunteer, or that we send to you in response, is transferred using industry standard encryption technologies. TKS does not collect, rent, sell, exchange or otherwise distribute data, including personally identifiable information (e.g., information such as name, address, phone number, e-mail, etc., or other information that identifies or could lead to the identification of a user as a particular person) for direct mail, advertising or any other commercial purpose. Nor would TKS exchange or trade such information with third-parties without a user’s explicit permission.
Security and Monitoring
1. In certain instances, a user may have the opportunity to receive or create a password to access or submit personally identifiable information. One should not divulge a password to anyone, and TKS will never ask a user for a password in a telephone call, fax, e-mail or other form of unsolicited communication. When a user is finished with an application or applications that are password protected, such user should exit the relevant page(s). 2. TKS does not collect personal information without your permission. Any information that you volunteer or that we send to you in response is transferred using industry standard encryption technologies or better security measures and systems into the design, implementation and day to day operation of Tkscontracting.com and its underlying servers and networks. Health Care Information
Any agency subject to the Health Insurance Portability and Accountability Act of 1996 and its regulations (collectively, “HIPAA”) that creates, receives, maintains, or transmits via Tkscontracting.com any Protected Health Information (“PHI”), as that term is defined by HIPAA, must comply with HIPAA’s Privacy and Security Rules. The agency must also require its Business Associates, as that term is defined by HIPAA, to comply with HIPAA when, on behalf of the agency, each such Business Associate creates, receives, maintains, or transmits PHI hosted by Tkscontracting.com. Sending E-mail to TKS Contracting, Inc.
We value your feedback. If you send an email to any of the email accounts listed on our Contact page, we do collect your email address and any other information that you volunteer. We do this to improve the content of our website and occasionally, to customize content for the individual user.
If a Tkscontracting.com user has elected not to receive further information from TKS, Tkscontracting.com will not send such information. If a Tkscontracting.com user has elected to receive further communication from TKS, Tkscontracting.com will only send information in categories that are authorized by the user. Telephone calls
Individuals may contact TKS via phone for certain services. The phone system automatically logs the phone number and other characteristics of calls to and from TKS numbers, such as call duration and the extension in the TKS that received or made a call. It is not possible to opt-out of this collection. During the course of your call, we may ask for additional information. This information will be used to help provide the requested service as is the case with requests submitted via the website. The call taker will inform you about what information may be optionally provided. We will also provide notice if and when a call center records calls for training purposes or to improve the services. We may also request personal information when we call you or notify you of an event via phone or text message, should you opt-in.
Fraudulent Emails
Please be aware that fraudulent email scams called “phishing” have been increasing in frequency. “Phishing” involves a victim receiving an e-mail appearing to be from a legitimate business. The “from” line is often forged and the e-mail usually contains authentic looking graphics making it appear to be legitimate. The email may also contain what appears to be a legitimate link to that organization. When the victim clicks on this link, they are then taken to what appears to be a legitimate looking website. Criminals can even make your browser’s address bar contain the address of the legitimate organization despite the fact that the website is a forgery. Victims are then encouraged to enter personal information including credit card numbers and expiration dates. TKS will not request confidential personal or financial information from our customers via an unsolicited email. TKS will also never send you an unsolicited e-mail containing a link to TKS‘s website where confidential personal or financial information is requested. On-line Transactions
For online transactions conducted on the TKS’s website, you will be asked to enter certain information about yourself and/or the organization with which you are affiliated. The specifics of this information will vary as required by the type of transaction (e.g., online job application).
In each case, any information submitted online for these activities is subject to the same safeguards as if you had engaged in these activities in person rather than over the Internet. Information collected in the course of the transaction is used in order to conduct the online transactions with the appropriate TKS departments, to communicate with you about your transaction, or provide information that may be useful to you. Confidentiality
Neither party will use or disclose the other party’s Confidential Information without the other’s prior written consent except for the purpose of performing its obligations under this Agreement or if required by law, regulation or court order; in which case, the party being compelled to disclose Confidential Information will give the other party as much notice as is reasonably practicable prior to disclosing the Confidential Information.
Severability Clause
“If any provision of this Agreement is held illegal or unenforceable in a judicial proceeding, such provision shall be severed and shall be inoperative, and, provided that the fundamental terms and conditions of this Agreement remain legal and enforceable, the remainder of this Agreement shall remain operative and binding on the Parties.”
CALIFORNIA RESIDENTS
Your California Privacy Rights. TKS collects information that you provide to us or that we learn about you from your use of our Websites or shopping at our stores, as described in this Privacy Policy. Under California law, once a year, TKS customers who are California residents may request certain information about our disclosure of your personal information to unaffiliated third parties for direct marketing purposes. TKS does not disclose any personal information to unaffiliated third parties for these purposes.
EU RESIDENTS
International Transfers of EU Customers’ Personal Information. The Personal Information that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area (“EEA”) in reliance on a variety of compliance mechanisms, including data processing agreements based on the EU Standard Contractual Clauses. TKS strongly believes that parental supervision is an important factor in Internet use by minors. Your browsing and interaction on any third-party website or service, including those that have a link or advertisement on our website, are subject to that third party’s own rules and policies. In addition, you agree that we are not responsible for and we do not exercise control over any third-parties that you authorize to access your User Content. Disputes, Agreement to Arbitrate, and Choice of Law
By using the Sites, you and TKS agree that, if there is any controversy, claim, action, or dispute arising out of or related to your use of the Sites, or the breach, enforcement, interpretation, or validity of this Privacy Policy or any part of it (“Dispute”), both parties shall first try in good faith to settle such Dispute by providing written notice to the other party describing the facts and circumstances of the Dispute and allowing the receiving party 30 days in which to respond to or settle the Dispute.
Both you and TKS agree that this dispute resolution procedure is a condition precedent that must be satisfied before initiating any litigation or filing any claim against the other party. IF ANY DISPUTE CANNOT BE RESOLVED BY THE ABOVE DISPUTE RESOLUTION PROCEDURE, YOU AGREE THAT THE SOLE AND EXCLUSIVE JURISDICTION FOR SUCH DISPUTE WILL BE DECIDED BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS. ARBITRATION ON AN INDIVIDUAL BASIS MEANS THAT YOU WILL NOT HAVE, AND YOU WAIVE, THE RIGHT FOR A JUDGE OR JURY TO DECIDE YOUR CLAIMS, AND THAT YOU MAY NOT PROCEED IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE CAPACITY. Other rights that you and we would have in court will not be available or will be more limited in arbitration, including discovery and appeal rights.
The arbitrator, and not any federal, state, or local court or agency, shall have exclusive authority to resolve any dispute arising under or relating to the interpretation, applicability, enforceability, or formation of this Privacy Policy, including any claim that all or any part of this Privacy Policy is void or voidable.
This Privacy Policy has been made in, and shall be construed in accordance with, the laws of the State of West Virginia, without giving effect to any conflict of law principles. The parties acknowledge that this Privacy Policy evidences a transaction involving interstate commerce. Notwithstanding the provision in the preceding paragraph with respect to applicable substantive law, any arbitration conducted pursuant to the terms of this Privacy Policy shall be governed by the Federal Arbitration Act (9 U.S.C. §§ 1-16).
